Actor Randy Quaid and his wife Evi failed to show up in court Monday morning in Santa Barbara, California on felony charges they stiffed the San Ysidro Ranch resort for a $10,000 bill.

The Quaid's new attorney, Ken Johnson of San Francisco, called the District Attorney's office last Friday and said the Quaids "just couldn't make it Monday -- that it was too soon."

In wake of the Quaids failing to appear in court, Senior Deputy District Attorney Lee Carter told RadarOnline.com: "I have begun the very lengthy process of preparing the extradition paperwork for the Quaids. It's my hope that the Quaids will voluntarily appear next Monday at 1:30 PM. There is still a warrant out for their arrest in California. It's my understanding that the Quaids have settled their outstanding bill with the San Ysidro Ranch. However, it's up to our office and the judge about if the charges should be dropped or not, no one else has a say in that."

Meanwhile, private investigator Becky Altringer, who once worked for the Quaids, told RadarOnline.com exclusively that the Quaids defiant no-show in court Monday morning is simply Evi's way of showing them she's in control.

Said Altringer: "Now, I ask myself "would the courts allow some other criminal to call in at the last minute and reschedule?" Hell no!. This case just shows how our justice system is unfair and inadequate."

Carter says the Quaids are not being given preferential treatment because they are celebrities. He says because of the time and expense of extraditing people to California, his office routinely gives people a couple of chances to surrender before lowering the boom on them.
